Article 1 — Purpose
These Terms of Use ("Terms") set out the terms and conditions under which ColisBled SAS makes its platform available to users, connecting parcel senders with individual carriers (referred to as "GP" for Package Manager).
The platform is accessible at colisbled.com and via the ColisBled mobile apps on iOS and Android.
Article 2 — Definitions
- Platform: the ColisBled website and mobile applications.
- User: any individual or legal entity registered on the platform.
- Customer: a user wishing to ship a parcel.
- GP (Package Manager): a user offering parcel transport services during their trips.
- Trip: a route offered by a GP between a departure city and an arrival city.
- Booking: a transport contract concluded between a Customer and a GP via the platform.
- Parcel: an item or set of items entrusted by the Customer to the GP for transport.
Article 3 — Registration and user account
Access to ColisBled's services requires creating a user account. Registration is free and open to any adult (18 years or older).
To register, the user must provide:
- A valid, verified email address
- A valid phone number
- Their first and last name
- A secure password
The user is solely responsible for keeping their login credentials confidential. Any access to the platform made from their account is deemed to have been made by the user.
ColisBled reserves the right to suspend or delete any account whose information proves inaccurate, incomplete or fraudulent.
Article 4 — Services offered
ColisBled offers the following services:
- Matching: connecting senders with carriers available on a given trip.
- Secure payment: payment processing via Stripe, held in escrow until delivery is confirmed.
- Real-time tracking: notifications and status updates throughout the transport.
- Rating system: mutual rating between customers and GPs after each transaction.
- Customer service: assistance available to resolve any dispute or issue.
ColisBled acts as an intermediary and is not a party to the transport contract concluded between the Customer and the GP.
Article 5 — User obligations
Every user agrees to:
- Provide accurate, complete and up-to-date information when registering and for each transaction.
- Use the platform in accordance with these Terms and applicable law.
- Not use the platform for unlawful purposes, including the transport of prohibited goods.
- Respect other users and behave in a courteous and professional manner.
- Not attempt to circumvent the platform's payment systems.
- Immediately report any suspicious or fraudulent behavior to customer service.
Article 6 — Specific obligations of GPs
In addition to the general obligations, GPs agree to:
- Provide valid identity documents when registering and at any time upon request.
- Have the legal capacity to transport parcels (valid travel document, customs declaration if applicable).
- Strictly comply with the announced departure and arrival dates and times.
- Take care of the entrusted parcels and hand them over to their recipient in good condition.
- Immediately inform customers and ColisBled in the event of an unforeseen situation (delay, cancellation).
- Not transport prohibited, dangerous or unlawful goods.
- Subscribe to an active GP subscription in order to publish trips.
Article 7 — Pricing and payments
Transport pricing is freely set by the GP and displayed before any booking.
For the Customer:
- Payment for the transport is made to the GP according to the terms shown on their profile (secure online payment and/or other payment methods offered by the GP).
- In the event of cancellation by the GP, the applicable refund terms are specified at the time of booking.
For the GP:
- ColisBled does not take any commission on transactions between the Customer and the GP.
- Access to the platform and its features requires subscribing to a monthly plan, the price of which depends on the chosen plan.
- ColisBled receives no compensation linked to the volume or amount of transactions carried out by the GP: its only source of revenue from this activity is the GP subscription.
Article 8 — Liability
ColisBled is an intermediation platform. As such:
- ColisBled is not liable for damage suffered by a parcel during transport, unless gross negligence on its part is demonstrated.
- Liability for the transport rests with the GP, in accordance with applicable legal provisions.
- ColisBled cannot be held liable for delays, loss or damage to parcels unless it has taken out a specific guarantee.
- ColisBled uses all reasonable means to ensure the platform's availability but does not guarantee uninterrupted access.
Article 9 — Intellectual property
All elements of the ColisBled platform (logo, design, text, images, source code, database) are the exclusive property of ColisBled SAS and are protected by intellectual property law.
Any reproduction, representation, modification or use, in whole or in part, of these elements without the prior written authorization of ColisBled SAS is strictly prohibited and constitutes infringement subject to criminal penalties.
Article 10 — Prohibited goods
It is strictly forbidden to hand over the following goods for transport via ColisBled:
- Narcotics and illegal substances
- Weapons, ammunition and explosives
- Banknotes, checks and securities
- Dangerous, flammable or radioactive materials
- Live animals
- Unpackaged perishable goods
- Stolen or smuggled goods
- Any item whose export or import is prohibited by customs regulations
Failure to comply with this list engages the user's criminal liability.
Article 11 — Termination and suspension
ColisBled reserves the right to suspend or terminate a user's access to the platform, without notice or compensation, in the event of:
- Violation of these Terms
- Fraudulent or abusive behavior
- Repeated reports from other users
- Non-payment of amounts due
The user may terminate their account at any time from their personal space. Termination takes effect immediately, subject to any ongoing transactions being completed.
Article 12 — Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the parties shall endeavor to find an amicable solution before any legal action.
If amicable mediation fails, the dispute shall be submitted to the competent courts of Paris, unless otherwise provided by mandatory law applicable to consumers.
In accordance with Articles L.611-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge.
